Terms of Service

1. Acceptance of Terms

By accessing or using the Your Town Story website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify registered users of material changes via email or in-app notification.

2. Description of Service

Your Town Story is a community platform that enables users to:

  • Record and upload short videos associated with specific public locations;
  • Generate QR code stickers that link to those videos;
  • Explore an interactive map of community-created location-based video content.

The Platform is intended to foster community connection, stewardship of public spaces, and positive engagement with local environments.

3. Eligibility

You must be at least 16 years of age to use the Platform. If you are under 18, you represent that you have the consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Registration

You must create an account to upload content or request QR code stickers. You agree to provide accurate, current, and complete information during registration.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of these Terms or for any conduct that we, in our sole discretion, deem harmful to the Platform, its users, or third parties.

5. User Content

5.1 Ownership

You retain ownership of all content you upload to the Platform ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, display, and perform your User Content in connection with operating and promoting the Platform.

5.2 Content Standards

All User Content must comply with the following standards. Content must NOT:

  • Contain hate speech, threats, harassment, bullying, or content that targets individuals or groups based on any protected characteristic;
  • Contain nudity, sexually explicit material, or graphic violence;
  • Promote illegal activity, drug use, or underage drinking;
  • Contain commercial advertising, spam, or promotional material;
  • Contain political campaigning or partisan messaging;
  • Infringe on the intellectual property rights of any third party;
  • Contain personally identifiable information of third parties without their explicit consent;
  • Misrepresent the location where the video was filmed;
  • Contain false, misleading, or deceptive information;
  • Encourage, glorify, or incite vandalism, property damage, or antisocial behaviour;
  • Violate any applicable local, state, national, or international law or regulation.

5.3 Location Accuracy

Videos must be filmed at or near the location they are tagged to. We may verify this using GPS metadata, and content found to be materially mislocated may be removed without notice.

5.4 Bystander Privacy

If other individuals appear in your video, you must obtain their consent before uploading, or ensure their faces and identifying features are not clearly visible. You are solely responsible for obtaining all necessary consents.

5.5 Content Moderation

All User Content is subject to review before publication. We reserve the right to reject, remove, or modify any content that violates these Terms, at our sole discretion, without obligation to provide a reason. Moderation decisions are final.

6. QR Code Stickers — Terms and Conditions

This section is critical. By requesting, receiving, or placing a QR code sticker, you agree to all terms in this section.

6.1 Nature of the Sticker

QR code stickers ("Stickers") are physical items generated by the Platform that link to approved User Content. Stickers are provided as a community engagement tool and are not endorsed, certified, or warranted by Your Town Story for any specific purpose.

6.2 Sticker Placement — Your Responsibilities

You are solely and entirely responsible for where and how you place any Sticker. By requesting a Sticker, you represent and warrant that:

  1. You have legal authority or explicit permission to place the Sticker at the chosen location. This may require permission from the property owner, local council, or relevant land management authority.
  2. You will comply with all applicable laws, including local council by-laws, anti-littering laws, property laws, heritage protection laws, and regulations governing the placement of signage or materials in public spaces.
  3. You will NOT place Stickers on:
    • Private property without the explicit consent of the property owner;
    • Heritage-listed buildings, monuments, or protected structures;
    • Traffic signs, signals, or road infrastructure;
    • Emergency service infrastructure or equipment;
    • Any surface where placement may create a safety hazard;
    • Any location where placement is prohibited by law.
  4. You accept that placement of Stickers may require permits or approvals in your jurisdiction, and it is your sole responsibility to obtain these.

6.3 No Agency or Endorsement

Placing a Sticker does NOT mean you are acting on behalf of, or with the endorsement of, Your Town Story, any government body, council, or organisation. You must not represent or imply otherwise.

6.4 Sticker Removal

Any authorised party (property owners, councils, land managers) may remove Stickers at any time. We accept no liability for removed Stickers. If we receive a complaint about a Sticker placement, we may contact you to request removal, deactivate the QR code link, or suspend or terminate your account.

6.5 Liability for Sticker Placement

You indemnify and hold harmless Your Town Story, its officers, employees, agents, and affiliates from any and all claims, damages, losses, costs, and expenses (including legal fees) arising from or related to the placement of Stickers by you.

6.6 QR Code Deactivation

We reserve the right to deactivate any QR code at any time, for any reason. A deactivated QR code will display a generic "content unavailable" message. We are not liable for any consequences of QR code deactivation.

7. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. We make no representations or warranties that the Platform will reduce vandalism, improve community engagement, or achieve any particular outcome. The Platform is a community tool, not a security service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS IS OUR TOWN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING ANY DAMAGES ARISING FROM THE PLACEMENT, REMOVAL, OR DEACTIVATION OF QR CODE STICKERS.

9. Indemnification

You agree to indemnify, defend, and hold harmless Your Town Story from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your use of the Platform, your User Content, your placement of QR code Stickers, or your violation of these Terms.
